1. Agreement to Terms

By accessing our website or engaging AlbWebSolution ("we", "us", "our") for web development services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

AlbWebSolution provides the following services:

• Custom web development (WordPress, PHP, React, Next.js)
• API integration and third-party system connections
• E-commerce store development and configuration
• Website performance optimization
• Figma to website conversion
• Web scraping and data extraction

The specific scope, deliverables, timeline, and pricing for each project will be defined in a separate project proposal or service agreement signed by both parties.

3. Project Engagement

Project Initiation

All projects begin with a discovery call or written brief. A formal proposal outlining scope, timeline, and cost will be provided before work commences. Work begins only upon written approval of the proposal and receipt of any required deposit.

Changes to Scope

Any changes to the agreed project scope must be requested in writing. Additional work outside the original scope will be quoted separately and requires written approval before proceeding. This may affect the project timeline and cost.

Client Responsibilities

Clients are responsible for:

• Providing timely feedback and approvals as requested
• Supplying necessary content, assets, and access credentials
• Ensuring provided materials do not infringe third-party rights
• Testing and reviewing deliverables within agreed timeframes

4. Payment Terms

Pricing

All prices are quoted in USD unless otherwise stated. Quotes are valid for 30 days from the date of issue.

Payment Schedule

• A deposit (typically 50%) is required before project work begins
• The remaining balance is due upon project completion and before final delivery
• For larger projects, milestone-based payment schedules may be agreed upon

Late Payments

Invoices are due within 14 days of issue. Late payments may result in work being paused until payment is received. We reserve the right to charge interest on overdue amounts at a rate of 1.5% per month.

5. Intellectual Property

Client Ownership

Upon receipt of full payment, clients receive full ownership of the custom code and assets created specifically for their project, excluding third-party libraries, plugins, and frameworks used in the build.

Third-Party Components

Projects may incorporate open-source libraries, themes, or plugins. These components remain subject to their respective licenses. We will disclose significant third-party components used in your project.

Portfolio Rights

We reserve the right to display completed projects in our portfolio and use them for promotional purposes, unless the client requests confidentiality in writing.

6. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the project. This includes business information, technical specifications, pricing, and client data. This obligation survives termination of the service agreement.

We will never share your access credentials, source code, or business data with third parties without your explicit written consent.

7. Warranties and Representations

Our Warranty

We warrant that all work will be performed professionally and in accordance with the agreed specifications. We will fix any bugs or defects in our code within 30 days of project delivery at no additional cost.

Limitations

We do not warrant that delivered software will be error-free or uninterrupted. We are not responsible for issues caused by third-party services, hosting providers, or client modifications made after delivery.

8. Limitation of Liability

To the maximum extent permitted by law, AlbWebSolution shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities, arising from the use or inability to use our services.

Our total liability for any claim shall not exceed the total amount paid by the client for the specific project giving rise to the claim.

9. Termination

By Client

Clients may terminate a project with 14 days written notice. Payment is due for all work completed up to the termination date. Deposits are non-refundable once work has begun.

By AlbWebSolution

We reserve the right to terminate a project if: payment obligations are not met, the client requests work that violates these terms or applicable law, or the working relationship becomes untenable. In such cases, payment is due for all work completed.

10. Governing Law

These terms are governed by applicable international commercial law. Any disputes will be resolved through good-faith negotiation. If negotiation fails, disputes will be submitted to binding arbitration.

11. Changes to Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the updated terms.
